These Terms of Service apply to services purchased from Form & Frame. By placing an order, you agree to these terms. Form & Frame is operated by Joseph Lomax as a sole trader in the United Kingdom.

  1. Our services

Form & Frame provides bespoke digital creative services, including AI-assisted product imagery, lifestyle imagery, advertising creatives and video content.

The exact deliverables, quantities, formats, revision allowance and estimated timescale are those stated in the package description and any written agreement made before work begins.

Our services are primarily intended for businesses and e-commerce brands.

  1. Orders and payment

Payment must be made in full when placing an order unless we have agreed otherwise in writing.

An order is accepted once payment has been received and we have confirmed that we can undertake the project. We may decline or cancel an order if the project falls outside our capabilities, appears unlawful or cannot reasonably be completed using the materials supplied. If we cancel before work begins, a full refund will be issued.

  1. Creative brief and client materials

You must provide a complete and accurate creative brief together with all required photographs, product details, branding, dimensions, references and other assets.

You confirm that you own, or have permission to use, every image, logo, trademark, design and other material supplied to us. You are responsible for ensuring that these materials do not infringe another person’s rights.

You agree to indemnify Form & Frame against reasonable claims, losses or costs resulting from materials you supply without the required rights or permissions.

  1. AI-assisted content

Our creative process may use artificial intelligence together with manual editing, retouching and creative direction.

AI-assisted content may contain small visual differences or interpretive details. You are responsible for reviewing and approving the final work before publishing or using it commercially, particularly where exact product dimensions, colours, materials, safety features or technical details are important.

We cannot guarantee that AI-assisted output will be completely unique or that similar content will not be generated elsewhere.

  1. Timescales and delivery

Estimated delivery times begin once payment, the completed brief and all required assets have been received.

Typical delivery is within 5–7 working days unless another timescale is stated or agreed. Delivery dates are estimates rather than guaranteed deadlines unless we expressly confirm a fixed deadline in writing.

We are not responsible for delays caused by incomplete information, unsuitable assets, delayed feedback, requested changes or circumstances beyond our reasonable control.

Completed files will normally be delivered electronically.

  1. Revisions

Each package includes only the number of revisions stated in its description.

A revision means a reasonable adjustment to work already created in accordance with the original brief. A new concept, new product, replacement brief, substantial change of direction or request outside the agreed scope may require an additional fee.

Revision requests should be clear, consolidated and submitted within 14 days of receiving the work. If no feedback is received within this period, the project may be treated as completed.

  1. Approval and accuracy

You are responsible for checking spelling, prices, claims, logos, product details, colours and all other content before approval or publication.

Once work has been approved, changes may be chargeable. Form & Frame is not responsible for losses resulting from an error that was visible in work approved by you.

  1. Intellectual property and usage rights

Once full payment has been received, you may use the final approved deliverables for your own business, website, social media, advertising and marketing.

Working files, unused concepts, prompts, methods, templates and internal production materials remain the property of Form & Frame unless agreed otherwise in writing.

Any third-party materials remain subject to their original licences and ownership rights. Because some deliverables are AI-assisted, we cannot guarantee that copyright or exclusive ownership will arise in every element under the laws of every country.

Form & Frame may display completed work in its portfolio, website and promotional materials unless confidentiality has been agreed in writing or you ask us in writing not to do so.

  1. Advertising and commercial results

We do not guarantee sales, advertising performance, conversion rates, platform approval or any particular commercial result from the use of our work.

You are responsible for ensuring that your advertising, product claims and use of the deliverables comply with applicable laws and the rules of any platform on which they are published.

  1. Cancellations and refunds

Cancellations and refunds are handled according to our Return and Refund Policy, which forms part of these terms.

Nothing in these terms limits any cancellation rights or other statutory rights that apply to you as a consumer.

  1. Problems with the service

We will provide our services with reasonable care and skill.

If you believe the delivered work does not match the agreed brief or has not been produced with reasonable care and skill, please contact us promptly. We will first be given a reasonable opportunity to correct or reperform the affected work.

  1. Limitation of liability

To the fullest extent permitted by law, Form & Frame will not be liable for indirect or consequential loss, loss of profits, loss of sales, loss of advertising spend, loss of data or reputational damage.

For business customers, our total liability relating to an order will not exceed the amount paid for that order.

Nothing in these terms excludes liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or rights that cannot legally be excluded.

  1. Events outside our control

We will not be responsible for delay or failure caused by events beyond our reasonable control, including service outages, software failures, illness, internet disruption or disruption affecting third-party platforms.

  1. Changes to these terms

We may update these terms occasionally. The terms applying to an order will be those available when the order is placed, unless a change is required by law.

  1. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory protections and rights available under the laws applicable to you.
